The Oklahoma Open Records Act exempts some arrest records from public disclosure. For example, juvenile, investigative, and inmate health records are not readily available to members of the public.
What Do Public Arrest Records Contain?
The Wagoner County Sheriff's Office and local police departments make arrest records available to public members online and in person. These records typically contain the arrestee's name, sex, race, age, residing city, inmate ID, booking date and time, charges, and release date and time.
Wagoner County Arrest Statistics
The Oklahoma State Bureau of Investigation (OSBI) has a Crime Statistics portal where individuals can find crime data of individuals arrested by law enforcement agencies in the state. The U.S. Immigration and Customs Enforcement (ICE) provides access to arrest records to members of the public through the Online Detainee Locator System. Users can perform a search using an A-Number or biographical details. Alternatively, requesters can visit the ICE field offices or detention facilities during business hours to obtain copies of arrest records. The United States Capitol Police (USCP) also provides public members with arrest summary reports for free online. This service is free. Users can narrow their searches using a crime summary, CFN number, crime date, or crime type. Interested persons can mail a completed Request Form to the USCP to obtain copies of arrest records. The Federal Bureau of Prisons (BOP) makes arrest records available through its Inmate Locator. A search can be conducted by number (BOP register number, DCDC number, FBI number, or INS number) or name (first, middle, or last). Researchers can also visit any BOP facility during business hours to obtain copies of arrest records.
Free Arrest Record Search in Wagoner County
The Wagoner County Sheriff's Office offers free arrest searches through its Inmate Search portal. When a search is conducted by name, the portal shows in-custody and released inmates. Individuals can also access arrest records for free on third-party portals. However, only basic information sufficient to identify the record will be available. How Long Do Arrests Stay on Your Record?
Per Okla. Stat. tit. 51 § 24A.8(13)(C), Wagoner County law enforcement agencies maintain arrest records for as long as needed for administrative purposes. This means an arrest can stay in a person's criminal record forever. However, Oklahoma law makes provisions for sealing such records through expungement, making them inaccessible to the public.
Expunge Wagoner County Arrest Records
An expungement refers to the process of sealing arrest records to prevent the public from accessing them. Eligibility applicants can send a Petition for Expungement Form to the Oklahoma State Bureau of Investigation (OSBI) for a processing fee of $150. The OSBI accepts payments by cashier's check or money order. Applicants can file one petition for multiple arrests in Wagoner County. However, separate petitions must be filed if the arrests occurred in multiple counties. The OSBI takes about a month to process an expungement.
Wagoner County Arrest Warrants
A magistrate has the authority to issue an arrest warrant when a complaint verified by an oath or affirmation is received showing probable cause about a public offense and that a defendant committed it (22 OK Stat § 171). The arrest warrant must specify the defendant's name pursuant to 22 OK Stat § 173. However, the magistrate can designate the defendant by any name if the actual name is unknown. The arrest warrant must also state the offense committed by the defendant, the issuing time, county, city or town, and the magistrate's signature and name of office. If the offense committed by the defendant is bailable, the magistrate must endorse the bail amount on the warrant. Per 22 OK Stat § 174, a magistrate directs an arrest warrant to a peace officer for execution. All arrest warrants, excluding those issued for violation of city ordinances, can be executed in any county in Oklahoma (22 OK Stat § 175).
Do Wagoner County Arrest Warrants Expire?
No, Wagoner County arrest warrants do not have expiration dates. They remain active until law enforcement officers execute them. The only exception is if the issuing judge recalls or quashes the arrest warrant.
