Sequoyah County Arrest Records

An arrest occurs when an individual is taken into custody or voluntarily submits to the authorities to answer for a crime. In Sequoyah County, Oklahoma, arrests can be made by law enforcement officers with or without a warrant or by private citizens under certain conditions.

A private citizen may arrest someone if a crime occurs in their presence or if sufficient evidence suggests a felony was committed, even if they did not witness it directly. After making an arrest, the private individual must promptly hand the suspect over to law enforcement or present them before a magistrate.

Once a suspect has been taken into custody, the law enforcement department books the arrestee and creates an arrest record. Arrest records comprise the details surrounding the arrest incident. The arresting agency typically maintains them, but arrest information may form components of Sequoyah County court records.

Are Arrest Records Public in Sequoyah County?

Yes. Sequoyah County arrest records are public under the Oklahoma Open Records Act (ORA). ORA compels public bodies to grant access to individuals requesting to inspect or obtain a copy of an arrest record. However, the law exempts the following information from public disclosure:

  • Juvenile arrest information
  • Medical records
  • Sensitive personal information
  • Police investigative information
  • Expunged arrest records

What Do Public Arrest Records Contain?

A public arrest record in Sequoyah County contains non-restricted arrest information. It usually details the arrestee's name, sex, race, age, last known address, and mugshot. The record also shows the arrestee's booking ID, charges, and booking date/time.

Sequoyah County Arrest Statistics

The Oklahoma State Bureau of Investigation's Crime Statistics website contains crime figures reported by local law enforcement agencies throughout the state. Researchers can look up crime statistics for any year, as well as crime trends by offense category. However, they can not see county-specific crime or arrest data. For that information, interested persons can contact local law enforcement agencies or access the FBI's Crime Data Explorer.

Find Sequoyah County Arrest Records

To obtain a Sequoyah County arrest record, inquirers should contact the agency responsible for the arrest. Copies of arrest records can be requested in person upon payment of the applicable fee. The local Sheriff's Office can assist those uncertain about the arresting agency. The Sheriff's Office also manages inmate records for the county, which are accessible through the Inmate Search page on its website.

The Oklahoma Department of Corrections is responsible for state-level inmates. The record of these inmates can be found by utilizing the Oklahoma Offender Lookup tool. This tool allows for a basic search using the inmate's OK DOC number, first name, last name, or date of birth.

Additionally, researchers can access the Bureau of Prisons (BOP) Inmate Locator to find records of individuals incarcerated from 1982 to the present. The portal supports searches by name, combining first name, middle name, last name, race, age, and sex. Alternatively, users can perform a number-based search using a DCDC, INS, FBI, or BOP number.

Free Arrest Record Search in Sequoyah County

Researchers may access Sequoyah County arrest records through third-party resources. These resources allow users to search for arrest records remotely at their convenience. However, because these resources are not official information channels, the information obtained may only be partially accurate.

Once a user performs a search, typically using the person's name on the arrest record, they usually become privy to some information without paying a fee. The researcher may need to pay a fee to access a record fully.

How Long Do Arrests Stay on Your Record?

Arrest records in Sequoyah County generally remain on record indefinitely. Criminal justice agencies are obligated to maintain and publicly disclose the arrest records of individuals when needed unless the record is confidential or has been expunged. Expungement in Oklahoma happens when an individual receives an expungement order from the court for an eligible arrest. The arrest will be erased from the person's record upon such an order.

Expunge Sequoyah County Arrest Records

In Oklahoma, expungement refers to sealing an arrest record, unlike in some states where it completely erases the record. Arrest records can be partially or entirely expunged. A partially expunged record is sealed from public access but remains available to law enforcement, while a wholly expunged record is sealed from both the public and law enforcement. However, even with complete expungement, a copy of the arrest record will remain with the state criminal history repository.

The eligibility requirement for the expungement of an arrest record is outlined in Title 22, Section 18 of the Oklahoma Statutes. Under the statute, expungement is possible if:

  • The person was acquitted of the arrest charges or had their conviction reversed by an appellate court.
  • The arrest or charges resulted from identity theft.
  • DNA evidence establishes factual innocence post-conviction
  • The individual received a full pardon from the Governor.
  • No charges were filed for the arrest, and the statute of limitations has expired.
  • The offender was 18 years old at the time of the offense and was granted a full pardon.
  • The arrest charges were for a misdemeanor and were dismissed after deferred judgment, with no felony convictions, and at least 1 year has passed.
  • The arrest charges were for a nonviolent felony and were dismissed after deferred judgment, with no felony convictions, and 5 years have passed.
  • The offender had a misdemeanor conviction with a fine under $501 and no felony convictions or pending charges.
  • The individual has a misdemeanor conviction with imprisonment and a fine over $500, no felony convictions, and five years have passed.
  • The offender received a nonviolent felony conviction, with no other felonies or recent misdemeanors, and 5 years have passed since completing the sentence.
  • The offender has no more than 2 felony convictions (nonviolent, non-sex offenses), with 10 years passed since sentence completion.
  • The offender had up to 2 felony charges dismissed after deferred judgment, with 10 years passed and no pending charges.
  • The person's conviction was for a felony that has since been reclassified as a misdemeanor, with the sentence completed, restitution paid, and treatment programs finished.

Eligible individuals may file a petition in court to have their arrest record expunged. For those with clean slate-eligible records, expungement may occur automatically. The Oklahoma State Bureau of Investigation (OSBI) reviews criminal history records each month to identify clean slate-eligible cases. Upon identification, the OSBI notifies the prosecuting and arresting agencies, who have up to 45 days to process the expungement or raise any objections.

Sequoyah County Arrest Warrants

An arrest warrant is a legal document containing an order to arrest a person accused of committing a crime. Law enforcement officers must typically possess a warrant before arresting an individual except under certain conditions. These conditions include when an individual is caught in an illegal act or if there is reason to believe a felony or domestic abuse has been committed.

To obtain a warrant, the requesting police officer must file a complaint verified by oath or affirmation in court. The sitting magistrate will issue an arrest warrant if the complaint sufficiently establishes probable cause. Issued warrants of arrest in Sequoyah County contain the following information:

  • The name of the defendant or an assigned name if the real name is unknown
  • The offense committed
  • The county, city, or town where the warrant was issued
  • The time of issuance
  • Bail amount (for bailable offenses)

Warrants are directed to and executed by law enforcement officers. A warrant of arrest issued in Sequoyah County is executable anywhere in Oklahoma except for warrants issued for city ordinance violations.

Do Sequoyah County Arrest Warrants Expire?

No. Sequoyah County arrest warrants remain valid until the person named in the warrant is arrested. However, a court can void an arrest warrant if it finds errors that make the warrant inexecutable or the grounds for arrest no longer exist.
