Rogers County Arrest Records Vs. Criminal Records
Arrest and criminal records in Rogers County are different, even if they are similar. For example, there is a difference in how both documents come about. An arrest record is from considerably earlier in the process—immediately following an arrest. On the other hand, a criminal record usually emerges following a conviction.
They also differ in the type and quantity of information they include. Criminal records are typically more detailed and depict an individual's path through the criminal justice system. Usually, they consist of:
- Arrests
- Charges
- Court verdicts (whether the arrestee was found guilty or not)
- Penalties (such as jail time, fines, or probation)
On the other hand, arrest records just detail the actual arrest. They could include information such as:
- The reason behind the arrest
- apprehending the agency and the officer
- The time, date, and place of the arrest
- charges brought at the time of the arrest (convictions may not always come from these charges)
How Long Do Arrests Stay on Your Record?
Depending on the offense, an arrest will stay on an individual’s record. Arrests sometimes remain on criminal records indefinitely. However, arrests for infractions like speeding tickets may not permanently stay on a person's record. Arrests for violent crimes and sexual offenses (particularly those carrying a sentence of more than a year in jail) are permanently recorded.
These arrests could remain on a person's record indefinitely:
- Firearm offenses
- Drug offenses.
- Child abuse.
- Driving under the influence
- Sexual offenses
- Domestic violence.
Additionally, arrests for theft, robbery, kidnapping, and prostitution may stay on a criminal record for 10-15 years.
Expunge Rogers County Arrest Records
In Rogers County, an individual can seal their arrest record through expungement. This means that once the expungement process is complete, the information in the record may no longer be accessible to the general public. A person may conduct a Section 18 expungement, allowing them to delete all their arrest records. In contrast, a person who has received a deferred sentence can apply for a Section 99(c) expungement to expunge their plea and update the case disposition to reflect the case's dismissal. A verdict of "Not guilty, case dismissed" will be the disposition. However, this does not remove the arrest record.
Interested parties must pay a $150 processing fee to expunge their arrest record. This fee must be paid to the local law enforcement organizations in charge of doing so. Qualified persons are to submit their petition for expungement to the Oklahoma State Bureau of Investigation (OSBI). To be eligible, a person must complete all court obligations and not be arrested for five years after their previous conviction.
The requestor must supply the following details in their Petition for Expungement or Order of Dismissal and/or Expungement to complete an expungement. This comprises:
- The name of the arrestee
- Social Security number
- Birthdate, offenses charged
- The arrest date
- The outcome (result) of an arrest and/or legal charges
After reviewing the request, the OSBI will determine if the requester is qualified for record erasure. If authorized, the OSBI will notify the court in writing of the decision to erase the data through an approval letter. The court will then forward the order to erase all agencies having custody of the records. The completed form needs to be forwarded to the following address, along with the $150.00 filing fee.
