Beckham County Arrest Records

In Oklahoma, a law enforcement or peace officer may arrest an individual with or without a warrant for an offense attempted or committed in the presence of the said officer. A person may also be arrested for committing or attempting to commit a felony where an officer of the law has reasonable cause to believe the suspect committed the offense in question. An offender involved in a motor accident will also be arrested where the officer has probable cause to believe that they are under the influence of alcohol (22 OK Stat § 196).

An arrest occurs when an officer of the law authorized to make arrests in that jurisdiction detains a person, takes them into official custody, and books them into the Beckham County Jail or holding cell in the Beckham County Office. Where offenders are formally charged and arraigned for the commission of a criminal offense following their arrest, arrest records are instrumental in creating Beckham County Court Records to document the criminal proceedings and record their criminal history.

Except otherwise provided by law, or any other statute applicable within the State of Oklahoma, government agencies and their custodians shall not deny an individual's request to access public information.

Where federal or state statutes declare certain records as confidential, such records shall be exempt from public disclosure. Individuals do not have the right of access to privileged or confidential information. The Oklahoma Open Records Act does not apply to the following records:

  • Records protected by attorney-client privilege
  • Social security numbers
  • Records where disclosure will lead to an unwarranted invasion of personal privacy
  • Law enforcement investigation files

Free Arrest Record Search in Beckham County

Residents of Beckham County can perform free arrest records searches using resources available at the Beckham County Sheriff's Office. Interested persons can contact the sheriff's office to request copies of arrest records.

Additionally, arrest information and criminal case court records usually contain basic arrest and conviction information. As a result, members of the public may find arrest information through the Beckham County Court Clerk's Office.

A third search option is a third-party public records search site. Third-party search sites are privately owned searchable databases that collate arrest records and other public records from multiple jurisdictions. While they are not free, they offer a more convenient search option as it does not require the user to make in-person visits or wait for long processing hours. However, compared to records from official government sources, records from third-party sites are usually not comprehensive and updated. The Court will then send a certified copy of the order to law enforcement authorities and the Oklahoma State Bureau of Investigation (OSBI). This process can take up to a month.

How Long Do Arrests Stay on Your Record?

Beckham County arrest records remain on your record indefinitely. Individuals can, however, petition the court in the county where they were arrested or charged to have the records of their arrest and all related court records expunged.

Expunge Beckham County Arrest Records

To expunge an arrest record means to seal the arrest record, thereby removing it from publicly accessible platforms. An expunged record is no longer public information and is not subject to the Open Records Act. Per Section 18, Title 22, of the Oklahoma Criminal Procedure Code, the following persons are authorized or eligible to file a motion at the court to have their arrest records expunged.

  • A person who has been acquitted
  • Where a conviction was overturned and the charges dismissed by an appellate court of jurisdiction
  • Where a person was declared innocent before or after conviction due to DNA evidence
  • Where a person received a full pardon from the Governor on the specific charges
  • Where all charges, whether felony or misdemeanor, have been dismissed, and the statute of limitations for all pending charges has lapsed.
  • Where the person was arrested and not charged
  • Where the person was convicted of a misdemeanor or non-violent felony offense, and at least 5 years (for misdemeanor) or 7 years (for felony) has passed since the completion of the sentence, and no other charges are pending against them.

Such a person may file a motion in the court in the county where they were charged or convicted to have the entire record of their arrest and all related court records expunged. If the court investigates and there are no objections to the motion or petition, and the petitioner has not been arrested or charged for any other offence, the court may approve the petition.

Beckham County Arrest Warrants

In Oklahoma, a judge issues an arrest warrant when they receive a complaint supported by an affidavit, which is usually filed by law enforcement officers stating that an offense had been committed and that the person named committed the offence. An arrest warrant is a legal document that authorizes a peace officer to arrest the named defendant(s) and bring them before the court.

A valid arrest warrant must contain the subject's name or a reasonable description, the offense, the date issued, the city or county of issuance, the signature, office, and title of the judge, and the timeframe within which the warrant may be executed.

Do Beckham County Arrest Warrants Expire?

No. Arrest warrants issued in Oklahoma do not expire. Unlike search warrants, arrest warrants remain active until they are executed or recalled. The statute of limitations on misdemeanor and felony offenses does not apply to arrest warrants. Peace officers are expected to execute warrants as soon as possible. Nonetheless, attempting to evade a warrant will only be inimical to the offender.
